According to information from the House Committee on Energy and Commerce, the Clean Air Act typically prevents individual states from setting their own vehicle emission standards. However, section 209 of the Act allows California an exemption through EPA waivers due to local air pollution issues. These waivers have enabled California to enforce a ban on new gas, diesel, and hybrid vehicle sales while mandating 100% electric vehicle sales by 2035. The passage of these resolutions by Congress is seen as an exercise of oversight responsibilities to address what they consider regulatory overreach by the previous administration.
